Terms of Service

1. Acceptance and eligibility

By creating an account or using Myndtrack, you agree to these terms. If you do not agree, do not use the service. You must be 18 or older to use Myndtrack.

2. What Myndtrack is

Myndtrack provides affirmations layered with binaural audio and music, for relaxation and personal development. It is for personal, non-commercial use. Myndtrack is a wellness tool, not a medical device. It makes no medical claims and is not a substitute for professional medical or mental health care. Please read our Medical & Safety Disclaimer, which forms part of these terms.

3. Accounts

You are responsible for keeping your credentials secure and for all activity under your account. Tell us promptly if you think your account has been accessed without your permission.

4. Subscriptions, credits and billing

Pro subscriptions are billed monthly or annually via Stripe and renew automatically until cancelled. You may cancel at any time from Settings (Manage billing); cancellation takes effect at the end of the current billing period. No refunds are issued for partial periods except where required by law.

The 7-day free trial is available to new subscribers only. After the trial, your card is charged the applicable rate unless you cancel before the trial ends.

Custom track credits are one-time purchases. A credit is used when you request a track and is returned automatically if generation fails. Credits are not refundable once a track has been generated, except where required by law.

5. Health and safety

You use Myndtrack at your own risk and are responsible for deciding whether it is suitable for you. Do not listen while driving, operating machinery or doing anything that needs your full attention. If you have epilepsy, a heart condition, a psychiatric condition or any other health concern, speak to a doctor first. Stop using the service if you feel unwell.

6. Your content and AI-generated content

You own the affirmations, notes and prompts you write. You give us permission to store and process them, and to send them to our service providers, only to run the service for you.

Scripts and music can be generated by AI from your input. AI output may be inaccurate, unexpected or unsuitable, and you should review it before use. Custom tracks are licensed to you for personal listening inside Myndtrack. You may not sell, publish or redistribute them or use them commercially.

7. Acceptable use

You may not use Myndtrack to generate content that is hateful, harassing, sexual involving minors, or that encourages illegal acts or self-harm. You may not attempt to reverse-engineer, scrape, overload or abuse the service or its APIs, or resell access to it.

8. Intellectual property

The Myndtrack app, design, audio engine and curated content are our property or are licensed to us. These terms give you a limited, personal, revocable licence to use the service.

9. Your library and notes

Your session history and notes are private to your account. You can edit or delete them at any time, and they are removed if you delete your account.

10. Suspension and termination

We may suspend or end access if you breach these terms or misuse the service. You can stop using Myndtrack and delete your account at any time from Settings.

11. Disclaimer of warranties

Myndtrack is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted or error-free, or that it will produce any particular result.

12. Limitation of liability

To the maximum extent permitted by law, Myndtrack and its owners will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill. Our total liability for any claim arising out of these terms or the service is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

13. Governing law

These terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Georgia, and you consent to their jurisdiction, unless the law where you live gives you the right to bring a claim elsewhere.

14. Changes

We may update these terms from time to time. Material changes will be notified by email or in the app. Continued use of the service after changes take effect constitutes acceptance.
